Jenkins: NFL must operate as a 21st century business

The Washington Post's Sally Jenkins joined The Toucher and Rich Show on Tuesday morning to discuss the latest in Deflategate as everybody awaits what will ultimately come of NFL Commissioner Roger Goodell's four-game suspension of Tom Brady.

One thing that currently seems to be working against the NFL is the fact that they failed to allow the NFLPA to call Jeffrey Pash as a witness.

The NFL said in the past that Pash was involved in the investigation, but later said he wasn't.

Judge Richard Berman seems skeptical, and that could help Brady's case.

"It certainly looks like it's a potentially fatal mistake because you look back at the record of this whole affair, and early on the NFL described Pash as the 'Co-leader of the investigation' or 'Co-Counsel'," Jenkins said. "The NFL has moved the goal line in several instances and that is one of them. Either Jeff Pash was involved in this investigation or he wasn't. Either his notes are germane to the case or they weren't. If they were and they appear to have been because he did in fact edit the Wells Report, then the NFL denied Tom Brady and his councel the opportunity to examine those notes and to examine Pash."
